Read This Terms of Use Agreement Before Accessing The Dealer Locator.

Welcome to Heliodyne’s Dealer Locator.  Heliodyne offers this free website feature solely for the convenience of our existing or prospective customers (“Customers”) in locating a dealer (“Dealer”) for the purchase and/or installation of our products (“Products”).  However, the use of this feature is subject to the following terms and conditions, all of which will be deemed to be accepted by the Customer immediately upon such Customer’s use of the Dealer Locator:

  1. Heliodyne makes no representations or warranties as to whether any of the Dealers has been duly licensed by the applicable state or local agencies for the sale and/or installation of the Products.  The Customer assumes any and all risk with respect to the licensing of any of the Dealers.  Heliodyne recommends that the Customer inquire with the Dealers as to the existence and sufficiency of any required licenses.

  2. Heliodyne makes no representations or warranties as to whether any of the Dealers carries liability, builder’s risk, property damage, workers’ compensation or any other type of insurance.  The Customer assumes any and all risk with respect to the existence of Dealer insurance covering the purchase and/or installation of the Products.  Heliodyne recommends that the Customer inquire with the Dealers as to the existence and sufficiency of any insurance.

  3. The Customer acknowledges and agrees that all Dealers are separate and independent from Heliodyne.  Heliodyne shall not be liable for any act or omission of any Dealer, including without limitation any alleged defect in workmanship or material supplied by any Dealer, or any bodily injury or property damage caused by any Dealer.

  4. The Customer releases Heliodyne from any and all liability in any way arising on account of a Dealer’s acts or omissions, including without limitation damages incurred by the Customer due to defective workmanship or materials or insufficiencies in licenses or insurance.  The Customer agrees that any liability of Heliodyne shall be solely as set forth in any express written warranty issued from Heliodyne to the Customer.
